WASHINGTON ? In an unforgiving display of partisanship, the Republican-controlled House approved emergency legislation Friday night to avoid an unprecedented government default and Senate Democrats scuttled it less than two hours later in hopes of a better deal.
"We are almost out of time" for a compromise, warned President Barack Obama as U.S. financial markets trembled at the prospect of economic chaos next week. The Dow Jones average fell for a sixth straight session.

It had been rewritten hastily overnight to say that before any additional increase in the debt limit could take place, Congress must approve a balanced-budget amendment to the Constitution and send it to the states for ratification. "Today we have a chance to end this debt limit crisis," Boehner declared, his endgame strategy upended by rebels within his own party.
But the changes he made to the House GOP bill further alienated Democrats. And they complicated prospects of a compromise that could clear both houses and win Obama's signature by next Tuesday's deadline.
At the other end of the Capitol, Senate Democrats rejected the measure without so much as a debate. The vote was 59-41, with all Democrats, two independents and six Republicans joining in opposition.
Moments later, Senate Majority Leader Harry Reid, D-Nev., unveiled an alternative that would cut spending by $2.4 trillion and raise the debt limit by the same amount, enough to meet Obama's terms that it tide the Treasury over until 2013.
Reid invited Republicans to suggest changes, saying, "This is likely our last chance to save this nation from default."
The Senate GOP leader, Mitch McConnell of Kentucky, accused Democrats of "rounding up `no' votes to keep this crisis alive," and noted the House had passed two bills to raise the debt limit and the Senate none.
The House, eager to return the Senate's favor rejecting the Boehner bill, set a vote to reject Reid's proposal on Saturday. The Senate set a test vote at about 1 a.m. on Sunday, a middle-of-the-night roll call that underscored the limited time available to lawmakers.
At the same time Reid appealed for bipartisanship, he and other party leaders accused Boehner of caving in to extremists in the GOP ranks ? "the last holdouts of the tea party," Sen. Richard Durbin of Illinois called them.
Republicans conceded that the overnight delay had weakened Boehner's hand in the endgame with Obama and Senate Democrats.
But the Ohio Republican drew applause from his rank and file when he said the House, alone, had advanced legislation to cut deficits, and that he had "stuck his neck out" in recent weeks in hopes of concluding a sweeping deficit reduction deal with Obama.
Boehner's measure would provide a quick $900 billion increase in borrowing authority ? essential for the U.S. to keep paying all its bills after next Tuesday ? and $917 billion in spending cuts. After the bill's latest alteration, any future increases in the debt limit would be contingent on Congress approving the constitutional amendment and sending it to the states for ratification.
"With conservatives insisting on the addition of a balanced-budget amendment requirement, Speaker Boehner's bill will now cut, cap and balance" federal spending, said Rep. Jeff Flake of Arizona as Friday's scheduled vote approached.
The White House called the bill a nonstarter. Press secretary Jay Carney issued a statement that called it a "political exercise" and said congressional leaders should turn their efforts to a compromise that Obama can sign by Tuesday.
The developments occurred one day after Boehner was forced to postpone a vote in the House for fear the earlier version of his measure would suffer a defeat. But by forcing a delay the conservative rebels upended the leadership's strategy of making their bill the only one that could clear Congress before a default and win Obama's reluctant signature.
"Everybody acknowledges that because of the dust-up yesterday we've lost some leverage," said Rep. Steven LaTourette, R-Ohio, an ally of the speaker.
The rebels said they were more worried about stemming the nation's steady rise of red ink.
Rep. Jeff Landry, R-La., a, a first-term lawmaker, issued a statement saying his pressure had paid off.
"The American people have strongly renewed their November calls of bringing fiscal sanity to Washington. I am blessed to be a vehicle driving their wishes to fruition," he said. "This plan is not a Washington deal but a real solution to fundamentally change the way Washington operates."
Administration officials say that without legislation in place by Tuesday, the Treasury will no longer be able to pay all its bills. The result could inflict significant damage on the economy, they add, causing interest rates to rise and financial markets to sink.
Executives from the country's biggest banks met with U.S. Treasury officials to discuss how debt auctions will be handled if Congress fails to raise the borrowing limit before Tuesday's deadline.
But Carney said the administration did not plan to provide the public with details Friday on how the government will prioritize payments.

In TransCore, a seeming clear statement that the license did not "apply to any other patents [already issued] or to be issued in the future" was insufficient to overcome the presumption of inclusion. In both TransCore and GPG, the presumption is derived both (1) from a reading of the terms of the written contract and (2) from equitable estoppel principles.
The case is also notable for its approval of the use of a preliminary injunction against the parties to stop proceedings occurring in a separate judicial forum.

Background: In a prior lawsuit, Leviton sued GPG for infringing two of its circuit interrupter patents. Prior to trial, the parties settled and Leviton issued a covenant not to sue GPG or its customers on the patents-in-suit. The settlement also included a venue clause ? indicating that any dispute would be "prosecuted exclusively in the U.S. District Court for the District of New Mexico."
After the settlement, Leviton continued to prosecute continuation applications stemming from the original patents and, in 2010, filed complaints in both the International Trade Commission (ITC) and the Northern District of California against GPG for infringing two of the continuation patents.
In response, GPC filed a declaratory action in the New Mexico court and persuaded the judge there to issue a preliminary injunction barring Leviton from pursuing its claims in either the ITC or California. GPC argued that the prior settlement implicitly provides the company with a license to the newly issued patents and that, according to the prior settlement, any dispute regarding the license must be decided by the New Mexico court.
On appeal, the Federal Circuit affirmed lower court's preliminary injunction.
This case presents a non-frivolous dispute regarding the scope of a patent license. The outcome of that dispute will determine whether the patentee can sustain its suit for infringement. Thus, there is no question in this case that the dispute "relates to or arises out of" the Settlement Agreement. The forum selection clause therefore applies, and the district court did not abuse its discretion in granting the preliminary injunction on that basis.
GPC's implied license argument is non-frivolous based upon the Federal Circuit's decision in TransCore v. Electronic Transaction Consultants Corp., 563 F.3d 1271 (Fed. Cir. 2009). In that caes, TransCore had previously settled a lawsuit that gave ETC (through MARK IV) a license to practice the patents in suit. The settlement specifically stated that the covenant not to sue "shall not apply to any other patents issued as of the effective date of this Agreement or to be issued in the future." However, when TransCore's continuation patent later issued, the Federal Circuit held that the new patent was also covered by an implied license and through legal estoppels. Here, the court found that the same principles apply.
From our holding in TransCore it reasonably follows that where, as here, continuations issue from parent patents that previously have been licensed as to certain products, it may be presumed that, absent a clear indication of mutual intent to the contrary, those products are impliedly licensed under the continuations as well. If the parties intend otherwise, it is their burden to make such intent clear in the license. It is well settled that parties are free to contract around an interpretive presumption that does not reflect their intentions.

Yesterday we posted information on our "Adoption Alerts" page about a young girl who has been in the foster care system for five years. Five years! That is way to long and, in my mind, simply unacceptable. Statistics tell us that if the foster care system in America does not change by 2012, 75,000 former foster children will be released from the system and be homeless. Each year, approximately 30,000 young people leave the foster care system without lifelong families, most at age 18. We must have a sense of urgency when it comes to foster care. If by next year 75,000 foster kids will be homeless, we have alot of work to do to prevent that from happening.
We need our government to make the adoption process much easier than it is now.
We need the 800 million people in our country who claim to be Christians to step up and be obedient to Gods call to help the orphans in their distress.
?We need prayer warriors who will commit to pray daily for the half-million foster children in our country. We here at heart4adoption cannot and will not rest until we do all we can do to find homes for these children. We will pray, hold events, post information, blog, do whatever we can to reach our goal. NEW YORK (Reuters) ? Stocks will be hard pressed to turn the tide of recent selling this week as political jousting over raising the United States' debt ceiling intensifies.
The benchmark S&P 500 index last week recorded its worst weekly loss in five weeks.
Investors, frustrated by the lack of progress in the debate between the Democrat-controlled White House and Senate and the Republican-majority House of Representatives, could move into what are perceived as safer assets, such as cash.
While the wrangling over the debt ceiling takes center stage, earnings season will continue to heat up after a solid first week. According to Thomson Reuters data, 39 companies in the benchmark S&P 500 index (.SPX) have posted results, with 74 percent reporting earnings that topped Wall Street estimates.
Companies in the index are forecast to show a 6.5 percent rise in profits over the second quarter of 2010 when all the reports are in.
For last week, the S&P 500 ended down 2.1 percent; the Dow fell 1.4 percent and the Nasdaq declined 2.5 percent.
The overhang from the debt ceiling issue could diminish the focus on earnings.
House Speaker John Boehner, the top Republican in Congress, said on Friday that President Barack Obama and Democrats still had not put a serious deficit plan on the table, underscoring the acrimony in negotiations to avert a government default.
"The news flow (this) week dealing with the deficit issues and the political posturing that is taking place is going to intensify and is really going to drive these markets," said Paul Mendelsohn, chief investment strategist at Windham Financial Services in Charlotte, Vermont.
"People are starting to get nervous about what they are seeing out there. For a portfolio manager -- let alone an average investor -- this is a treacherous market to be trying to position yourself in."
ECONOMY IS A "DISASTER"
Economic data on tap for the coming week includes several reports on the housing market -- June housing starts on Tuesday and existing-home sales on Wednesday. In addition, data is due on leading economic indicators for June and the Philadelphia Fed survey of manufacturing activity in the Mid-Atlantic region. Economic reports over the last month have raised questions about the health of the U.S. recovery.
"The bigger picture is the economy is still a disaster," said Joe Saluzzi, co-manager of trading at Themis Trading in Chatham, New Jersey.
Saluzzi said people still are watching earnings for signs growth may be stagnating. "Eventually, companies are not going to keep cutting costs."
Quarterly results are expected from a slew of companies this week, with more than 10 Dow components scheduled to report.
Major financial companies due to report include Goldman Sachs (GS.N), Morgan Stanley (MS.N), Bank of America Corp (BAC.N) and American Express (AXP.N). Also on the calendar are earnings news from technology companies Apple Inc (AAPL.O), Microsoft Corp (MSFT.O) and Intel Corp (INTC.O).
"Let's see what all the rest of these guys have. Let's see if it's still being driven by cost cuts or are they actually getting revenue gains. That is going to tell me a lot more than if they cut the debt deal," said Saluzzi.
After the S&P 500 weekly loss, the index was just below its 50-day moving average, a technical level that could indicate more selling. Some analysts believe the market could still come back if the U.S. debt issue is resolved soon.
"This area, as far as it pulling back, is balancing the threat of a default, but it would take an actual default to take us much lower than here," said Marc Pado, U.S. market strategist at Cantor Fitzgerald & Co in San Francisco.
But the longer the debt ceiling question continues without a conclusion, the bigger the risk for further declines in stocks and for volatility to spike. The CBOE Volatility index (.VIX) rose nearly 30 percent last week
"The more it drags out into Tuesday, Wednesday, Thursday or whatever, then we've got some serious issues. That will be an overhang no matter how good the financials come in terms of earnings reports next week," said Tommy Huie, chief investment officer of BMO Asset Management U.S. in Milwaukee, Wisconsin.
"It could be a pretty volatile week, no doubt about it."
