Tunisia mulls further charges for Femen activist

KAIROUAN, Tunisia (AP) ? Prosecutors on Thursday considered bringing more charges against a Tunisian member of the Ukrainian feminist group Femen, as hundreds of protesters shouted slogans against her outside her trial in the religious center of Kairouan.

Amina Sboui, who was long known by her pseudonym Tyler, appeared in court smiling and enveloped in a white robe. She was questioned by the judge over her possession of pepper spray, the basis of the charge against her of carrying an incendiary object.

The comparatively minor accusation, however, may have two more serious charges added, including desecrating a cemetery and offending public decency, according to defense lawyer Mokhtar Jannene, who said they are now being considered by prosecutors.

Outside the court some 200 protesters, many religious conservatives, chanted slogans against Sboui, accusing her of attacking the city and insulting Islam. They also shouted insults at the defense lawyers and accused them of "sullying" the image of the city, a center for religious pilgrimage and home of Tunisia's holiest mosque.

Sboui scandalized Tunisia in March by posting online photos of herself topless with the slogan "my body is my own" written on her torso.

She went into hiding because of death threats but re-emerged May 19 in Kairouan, where she scrawled "Femen" on a cemetery wall near the city's main mosque. Sboui was detained by police as an angry mob gathered around her. On the same day, police stopped a group of ultraconservative Muslims from holding their annual conference, resulting in clashes and tear gas ? heightening the tensions over the Sboui case.

In court, her lawyers argued that the 1894 statute on "incendiary objects" should not apply to her can of pepper spray. That charge carries a potential penalty of six months in prison.

She told the judge that she had been given the pepper spray by a foreign journalist for her own protection and had been carrying it for the last two months. The judge adjourned the session to deliberate on the charge.

The other two charges, if brought forward, carry longer sentences of up to two years in prison.

Sboui's father was present in court and expressed his support for his daughter.

"I am proud of my daughter who has honored the rights of women," Mounir Sboui told The Associated Press. "Maybe her acts were rash, but this is her way of expressing these ideas."

The case is the latest flashpoint in the battle over Tunisia's identity after the overthrow of the secular dictatorship in January 2011 saw the rise of ultraconservative Islamists known as salafis pushing for greater piety.

The case attracted attention in Europe and three members of Femen, two French and a German, demonstrated topless in front of Tunis' court building Wednesday, calling for Sboui's release. They were arrested and remain in custody. They are set to appear before a judge on Friday, when they may be charged.

Suit filed over copter crash during reality shoot

LOS ANGELES (AP) ? The mother of a man killed when a helicopter crashed during a shoot for a reality television show has claimed in a wrongful death lawsuit that the aircraft's operators and producers negligently operated the helicopter.

Jerie S. Rydstrom filed the lawsuit Wednesday, claiming the helicopter's operators negligently maintained and operated the Bell 206B Jetranger that was used during filming. Darren Rystrom was one of three people, including a pilot, killed during the early morning crash on Feb. 10 in the Acton area of northeast Los Angeles County.

The men were filming a scene for an untitled military-themed show being produced for the Discovery Channel, which is not named in the lawsuit.

The case's defendants are Van Nuys Copters and Orbic Air, the companies responsible for the lease of the helicopters; the estate of pilot David Gibbs; and reality television producers J.D. Roth and Todd Nelson.

Phone messages left for the companies and the men were not immediately returned Thursday.

"Defendants negligently failed to insure that the Bell 206B helicopter was functionally equipped and capable of operating over such terrain at night under visual meteorological conditions and failed to ensure that it was serviceable for the intended flight," the suit states.

The lawsuit seeks unspecified damages for loss of companionship, earnings, and for the pain and suffering caused by Darren Rystrom's death and any pain and mental anguish that he suffered during the crash.

An initial report by the National Transportation Safety Board report stated the helicopter was being used for scenes in which an actor dropped a backpack to the ground from the hovering aircraft.

The production crew on the ground was not filming at the time, but there was a camera operator aboard and a GoPro camera pointed at an actor in the left front seat, the report said. The recording devices were sent to NTSB headquarters for examination.

(AP) ? U.S. stock futures rose sharply to start the week after the three-day holiday weekend and ahead of the latest update on the mood of the American consumer.

Dow Jones industrial futures rose 114 points to 15,421. The broader S&P futures added 13.2 points to 1,663.80. Nasdaq futures rose 28.25 points to 3,020.50.

The Conference Board will release its consumer confidence report at 10 a.m. Eastern Tuesday and economists believe that the reading will rise for the second time in as many months.

The S&P/Case-Shiller home price index for March is also due. Last month, the report showed that prices in the top 20 cities rose 9.3 percent in the past year. It was the fastest year-over-year increase since May 2006.

New virus called ?threat to entire world?

The first death in France from a new SARS-like coronavirus brings the worldwide total for the disease to 27 deaths and 49 infections, CNN reports.

The 65-year-old Frenchman was diagnosed after returning from a stay in Dubai.

According to CNN, the World Health Organization has said that the disease was first seen in Saudi Arabia last year. The virus is "a threat to the entire world," Margaret Chan, WHO's general director, told the network.

The Centers for Disease Control explains that coronaviruses can affect people or animals and, in worst-case scenarios, cause SARS (severe acute respiratory syndrome).?And it notes there's currently no vaccine to protect against human coronavirus infection.

The disease acts like a cold and causes upper respiratory system problems. Symptoms include fever and cough, and can lead to kidney failure and pneumonia.

The WHO has not learned how the new virus spreads, making it difficult to prevent infections. The organization has named it, though: Middle East Respiratory Symptom Coronavirus, or MERS-CoV, according to CNN.

UW Oshkosh Today ? Eighteen honored with Chancellor's Award for ...

Chancellor's award winners reception at Chancellor Wells' home.

Eighteen senior students who exemplify high academic and leadership qualities and a deep commitment to serving others will be recognized on May 11 as recipients of the Chancellor?s Award for Excellence. The criteria for this award include academic performance, University-related service and community involvement.

Here?s a snapshot of each Excellence Award winner:

Michelle Arenz graduates with majors in studio art and journalism. On campus, Arenz served as the president of the Reeve Union Board, chairperson for the Concerts Committee and as a core leader for Converge. She also served as a tour guide for the admissions office. More broadly, Arenz was the promotions team leader for PULSE in Oshkosh and Milwaukee. Arenz also was also the recipient of several scholarships during her time at UW Oshkosh, including the John and Pat Kerrigan Scholarship, which is given to sophomore students with strong academic and leadership potential, and the Paul S. Donhauser Scholarship, which is awarded to art students showing dedication to the program.

Ross Bartelt graduates with majors in international studies, history and German. Among his most memorable college experiences are his involvement with Model United Nations and a semester abroad in Germany. Bartelt was involved with the ?UW Oshkosh Student Association and served as director of student legal services; he also held a job with facilities management. Bartelt served as the president of the History Club and the founder and president of the German Club; he also was involved with many other activities and areas of service. His high marks earned him spots on both the dean?s list and multiple national honor societies.

Charles Block graduates with a major in supply chain management. On campus, Block worked with Career Services as a career resource representative and as a cadet with the UW Oshkosh Battalion. He further spent time volunteering locally for special events with Special Olympics, Cerebral Palsy and The Arc. As a member of the Army, Block was named a distinguished military graduate ?from Army ROTC; he also earned an officer of the year recognition and several medals for achievements. He plans to remain involved with the Army Reserves.

Jacqueline Charapata graduates with a major in elementary education. Charapata was both actively involved in the classroom at Horace Mann Middle School in Neenah where she student taught as well as within the community where she tutors struggling readers and writers; she also spent time at Franklin Elementary School in Oshkosh as an elementary education clinician. She recently concluded her last ten weeks as a student-teacher in South America. Charapata also held a leadership role as the networking director for the Society for Human Resource Management.

Michelle Duren graduates with a major in political science. On campus, Duren first became involved with the American Democracy Project, which eventually led to an internship. She also gained professional experience through her work with UW Oshkosh Career Services, as a French research assistant in the foreign language department and as a special assistant to a state representative. Within the community, Duren was civically involved with the Winnebago County Democrats, as an election official for the city of Oshkosh and as a board member for the Oshkosh Food Co-op. Duren plans to pursue a master?s degree in public policy beginning this fall.

Elizabeth Gill graduates with a major in special education. Gill was deeply involved with the Department of Residence Life at UW Oshkosh where she held roles as a community development specialist, community adviser and with residence hall government; she was awarded Team Player of the Year and Resident Assistant of the Month awards from the National Residence Hall Honorary organization. Gill also demonstrated leadership through her role as a tour guide with admissions, via her participation in diversity events and conferences, through volunteer and practicum work at local schools and through involvement with various organizations ?and committees.

Shannon Henry graduates with a major in supply chain management. On campus, Henry served as the president for both Advancing Productivity, Innovation and Competitive Success (APICS) and Phi Beta Lambda; she was also involved as a College of Business ambassador. Henry?s passion to learn through travel and experiencing new cultures took her on study abroad trips to Italy, Peru and Ireland during her time at UW Oshkosh. Henry was recipient of both the Edwin and Dorothy Hartman and the Wisconsin Family Business Forum scholarships.

Ashley Leonardelli graduates with a major in psychology. While on campus, she was involved with Psi Chi, the international honor society for psychology, as well as with a research initiative that led her to participate in the annual Celebration of Scholarship. Leonardelli also participated in an alternative spring break trip to New York. Leonardelli was the founder and executive board member of the Social Justice Club at UW Oshkosh as well as a member of the International Student Association, Campus Awareness for Relationship Education (CARE) and the Psychology Club. She was actively involved with charitable work with Wisconsin Special Olympics and Christine Ann Domestic Abuse Services.

Madeline Meis graduates with majors in international studies and Spanish. Among the most impactful parts of Meis? college experience was a study abroad trip to Argentina. Meis served as the vice president of the Oshkosh Student Association, as a teaching assistant for international studies and as a peer advising liaison. She was also involved with Model United Nations, the Parking Appeals Committee, the Differential Tuition Committee and as a College of Letters and Science student association senator. In her community, Meis has volunteered with the Oshkosh Dragonboat Festival, Hands on Oshkosh and the Wisconsin Music Association.

Kelli Parr graduates with a major in science education. With the goal of becoming a teacher, Parr is involved with the National Science Teachers Association at UW Oshkosh; she also was a member of Golden Key International Honor Society and the Sign Language Club. Parr was recognized for her commitment to her education through four scholarships and with an Educational Testing Services (ETS) Recognition of Excellence Award. To gain experience related to her field of study, she also worked as a teaching assistant for Science Outreach, as a tutor for Project Success and as a STEM Coordinator for the Center for Academic Resources.

Mayur Ranpara graduates with majors in accounting and finance. Being involved with professional organizations was important to Ranpara during his time at UW Oshkosh, leading him to get involved with the Accounting Club, The Institute of Management Accountants and as a volunteer for the Oshkosh Area United Way?s tax assistance program. Professionally, Ranpara gained experience through three internships throughout the Fox Cities. He was the recipient of six scholarships and was a portfolio manager for the Student-Managed Endowment Fund in the College of Business.

Marissa Reynolds graduates with a major in political science. Reynolds? interest in civic duty led her to serve on the Winnebago County board of directors and with the College Democrats of Wisconsin as chair; she also volunteered for several campaigns. On campus, Reynolds was involved with the Political Science Student Association as president, the Pre-Law Society as vice president and the American Democracy Project as a member. Reynolds was involved as a volunteer in her community through work with the Winnebago County Free Legal Assistance Clinic and the Oshkosh Area Humane Society.

Benjamin Sanderfoot graduates with a major in science education. Sanderfoot worked as an undergraduate teaching assistant for the geology laboratories on campus as well as a geology tutor; the work led him to earn one of four national awards given to earth science teaching assistants. Sanderfoot was involved in Geology Club as president, with College Day for Kids and Science Safari and as a Science Olympiad judge. Within the greater community, Sanderfoot plays saxophone for his church; he also led a youth group for Oshkosh Earth Science Club and a Boy Scout geology group.

Madysen Schmidt graduates with majors in anthropology and sociology. At UW Oshkosh, Schmidt gained professional leadership experience through her roles with United Students in Residence Halls, where she served as co-chair for the leadership development committee and president of the organization. She also worked with the admissions office as a tour guide, a Titan Gold Corps member and as a member of the social media team. Schmidt was involved with the French Club, Beat2Soul Dance Crew and the freshman honor society Alpha Lambda Delta. She plans to pursue a career in student services.

Sitha Thor graduates with a major in biology. As a nontraditional student who returned to UW Oshkosh after a hiatus, Thor was motivated to work hard. He?s a student researcher with grant funding through both the UW Oshkosh McNair Scholars program and the Undergraduate Student Collaborative Research program. Thor has delivered four professional scholarly presentations; he?s also worked with Student Support Services as a First Year Scholars Leader, Learning Communities Leader and as a tutor. At UW Oshkosh, he started the Table Tennis Club and participated as a volunteer in Science Safari and Hands on Oshkosh.

Jake White graduates with a major in journalism. Being in front of a crowd comes easily to White. During his time as a student, he founded Jake White Speaks and Party.0 Sober Parties. On campus, he was involved as president of the Reeve Union Board, as the budget manager for the University Speaker Series and as the stage manager for the Dragonboat Race and Festival in 2010. Volunteer work led him to the Oshkosh Area Food Pantry and to Habitat for Humanity, Smith Elementary School and EAA as a participant in Hands on Oshkosh. He also participated as a judge for the National Catholic Forensics and Communications Association.

Jingyi Xiang graduates with majors in economics and math. Xiang came to UW Oshkosh as an exchange student where she made the most of her education despite a language barrier. Xiang was a tutor in the math department, an economics and math teaching assistant and a peer leader for the Office of International Education. She grew her leadership skills through roles as president of the International Student Association, as an educator and fundraising chairperson of the Gamma Alpha Omega sorority, as a networking team facilitator for the National Society for Leadership and Success and as president of the Chinese Culture Club. She also gave of her time as a volunteer for community events and organizations.

April Young graduates with majors in environmental studies and sociology. Young was involved on campus as a student advising mentor for the environmental studies department, as a peer advising liaison with the Undergraduate Advising Resource Center and as a content tutor for the Center for Academic Resources; she was also involved with the Sociology Club as president and as a Karate Club member. Within the greater community, Young was active in volunteering for the Green Bay Wildlife Sanctuary and the WISPIRG Energy Service Corps.

FAA to staff 72 airport control towers at night

WASHINGTON (AP) ? The Federal Aviation Administration says it will keep open 72 airport towers and other air traffic control facilities that were slated to close overnight as the result of automatic spending cuts imposed by Congress.

The agency made the announcement Wednesday following a conference call with airlines and groups representing business and private pilots.

The FAA had announced earlier this year that it would eliminate midnight shifts of air traffic controllers at 69 airport towers and two regional approach control facilities in order to save money.

The list included some at major airports like Chicago's Midway International and General Mitchell Airport in Milwaukee.

The elimination of midnight shifts at some airports was in addition to widespread controller furloughs last month. FAA ended the furloughs after Congress provided the agency more money.

NYC set to pass sick days plan, seen as key step

NEW YORK (AP) ? A national push for paid sick days is poised to score a significant victory in New York City.

The City Council is expected to vote Wednesday to require businesses to provide sick leave to an estimated 1 million workers who don't have it now. About 300,000 more would get unpaid sick time, so they couldn't be fired for calling in sick.

A mayoral veto is expected, but so is an override.

Advocates see the New York measure as a watershed, though it wouldn't take effect for a year ? and then only if the economy stays steady. The city would be the most populous place to approve such a law.

Critics fear it could burden small businesses. Opponents also say government should let employees and businesses set sick time arrangements.

Limo that went up in flames had extra passenger

REDWOOD CITY, Calif. (AP) ? A stretch limousine that burst into flames on a San Francisco Bay bridge, killing five women inside, was carrying one too many passengers, investigators said Monday.

The state Public Utilities Commission had authorized the vehicle to carry eight or fewer passengers, but it had nine on the night of the deadly fire, California Highway Patrol Capt. Mike Maskarich said. He did not comment on whether the overcrowding may have been a factor in the deaths.

The cause of the blaze remains under investigation, and the vehicle has not yet been inspected, Maskarich said.

The Lincoln Town Car was packed with young women celebrating a girls' night out with a newlywed bride when it went up in flames Saturday night on the San Mateo-Hayward Bridge. The driver and four women were able to escape.

The newlywed woman was among the dead.

The driver, Orville Brown, said at first he misunderstood what one of the passengers in the back was saying when she knocked on the partition between the passenger area and the driver compartment and complained about smelling smoke.

With the music turned up, he initially thought the woman was asking if she could smoke. Seconds later, he said, the women knocked again, this time screaming, "Smoke, smoke!" and "Pull over," Brown told the San Francisco Chronicle (http://bit.ly/10jcd0t ).

He helped four of the surviving women escape through the partition. One of the women ran around to the passenger door on the back side of the limo, but by then it was engulfed in flames.

"When she opened that back door, I knew it wasn't a good scene," Brown said. "I figured with all that fire that they were gone, man. There were just so many flames. Within maybe 90 seconds, the car was fully engulfed."

The five dead were found huddled near the partition, apparently unable to squeeze through. They have not yet been identified.

"My guess would be they were trying to get away from the fire and use that window opening as an escape route," said San Mateo County Coroner Robert Foucrault.

Firefighters arrived within minutes and extinguished the blaze. Investigators have done preliminary interviews with survivors and the driver but need to re-interview them, Maskarich said.

The investigation was expected to take several weeks to complete, he added.

Two of the survivors were still hospitalized Monday in critical condition.

Investigators were trying to determine whether any crime occurred. Foucrault said they doubted that the blaze involved criminal activity.

Relatives told the San Francisco Chronicle and the San Jose Mercury News that one of the dead was Neriza Fojas, a 31-year-old registered nurse from Fresno who recently wed and was planning to travel to her native Philippines to hold another ceremony before family. Her friends in the limousine were fellow nurses.

Brown, 46, of San Jose, said he was taking the women across the bridge to the Crowne Plaza Hotel in Foster City. Fojas' sister, Rosalyn Bersamin, told the Chronicle that after a night out on the town, Fojas and her friends were heading to the hotel to celebrate with her new husband.

"She was a hard worker, a loving sister," a sobbing Bersamin said.

Aerial video shot after the fire showed about one-third of the back half of the limousine had been scorched. Its taillights and bumper were gone, and it appeared to be resting on its rims, but the remainder of the vehicle didn't appear to be damaged.

A photo taken by a witness and broadcast on KTVU-TV showed flames shooting from the back of the limo.

Brown said he wishes he could have done more.

"It's something you never imagine will happen," he told the Chronicle. "It's a limousine ride. It's supposed to be a joyous thing."

Brown said he is an experienced commercial driver who has operated airport shuttles and trucks.

He started driving for Limo Stop Inc. two months earlier and had put in about six shifts behind the wheel of the Town Car that caught fire, he said.

Medical examiners will identify the victims by using dental records. Foucrault said the autopsies will include toxicology tests, as well as examinations into whether any accelerant such as alcohol or gasoline was found on the bodies.

The CHP said the four other women who escaped the fire were being treated at nearby hospitals for burns and smoke inhalation. They were identified as Mary G. Guardiano, 42, of Alameda; Jasmine Desguia, 34, of San Jose; Nelia Arrellano, 36, of Oakland; and Amalia Loyola, 48, of San Leandro.

Desguia and Loyola were listed in critical condition Monday, a spokeswoman for Valley Medical Center said. The condition of Arrellano, who was taken to another hospital, was not known.

A spokeswoman for Community Medical Center in Fresno said one or more of its employees were in the limo.

Limo Stop offers service through limousines, vans and SUVS. Records of the California Public Utilities Commission, which regulates limousine companies, showed the company is properly licensed and insured.

The company issued a statement pledging to do "everything possible" to help determine the cause of the fire and "bring forth answers and provide closure" to victims and their families.

Treasury says to begin selling remaining GM stake

WASHINGTON (Reuters) - The Treasury Department said on Monday it will begin another round of sales of the General Motors Co stock it acquired during the government's bailout of the U.S. auto sector.

The move follows a registration statement by GM last month making it easier for the Treasury to sell its remaining 241.7 million shares, or nearly 18 percent, of common stock of the No. 1 U.S. automaker.

It also will bring GM a step closer to eliminating the stigma of government ownership.

GM executives have chafed under the tag of "Government Motors" since its 2009 government-sponsored bailout and bankruptcy that left the U.S. Treasury with 60.8 percent ownership of the Detroit automaker.

After GM's November 2010 IPO, the Treasury's share of GM's common stock fell to 32 percent. Last week, GM came within 56 cents of its IPO price of $33 after it reported better-than-expected first-quarter earnings.

"We are pleased with the progress to date and will continue exiting this investment in accordance with our previously announced plan and timetable, and in a manner that maximizes returns for taxpayers," Tim Massad, Treasury assistant secretary for financial stability, said in a statement.

In December, the Treasury said it would fully exit its GM investments within the following 12 to 15 months, "subject to market conditions." But it gave no specific dates for the resumption of share offerings.

Also in December, GM repurchased 200 million shares of its common stock from the Treasury. At the time, Treasury said the sale was for $5.5 billion.

By the end of March, the U.S. government had recovered $30.4 billion of the $49.5 billion used to bail out GM under the Troubled Asset Relief Program, the TARP special paymaster said recently.

It is unlikely that the taxpayers will be fully repaid for the TARP bailout as Treasury exits. Treasury officials have said the goal was not to turn a profit on owning GM shares, but rather to save U.S. jobs.

Executives at GM have said that putting this issue behind them will improve the company's image and boost sales as they believe some consumers have held the bailout against them.

GM offered no fresh comment to the Treasury move on Monday. A spokesman said the company stood by the comments of Chief Executive Dan Akerson from last December.

Akerson at the time said Treasury's move to exit GM ownership "is an important step in bringing closure to the successful auto industry rescue," and "further removes the perception of government ownership."

The automaker's shares were not much moved by the news. On Monday afternoon, GM shares were up 1 cent at $32.11 on the New York Stock Exchange.

While Treasury now owns nearly 18 percent of GM shares of common stock, its ownership is about 16.4 percent of GM's diluted shares.

Last-minute stay in Mississippi execution; Texas executes inmate

JACKSON, Mississippi (Reuters) - A Mississippi inmate due to be executed on Tuesday was granted a last-minute reprieve because of overstated evidence, while Texas executed a man convicted of killing another person during a robbery in 2003, authorities said.

The Mississippi state Supreme Court granted a stay of execution to Willie Jerome Manning, 44, after federal authorities said they had overstated the strength of hair and gun evidence in his trial for the killing of two college students.

Manning had been scheduled to be put to death by lethal injection for the 1992 murders, and his lawyers had asked for a delay in light of the revelations. The court did not give a reason for its 8-1 decision to grant the reprieve.

"I am very happy and very relieved (about) the stay," said Manning's attorney, David Voisin. "The order demonstrates that the court is taking our pleading seriously."

In Texas, Carroll Parr, 35, was put to death by lethal injection for pistol-whipping then killing a man in 2003 from whom he had purchased marijuana, the state Department of Criminal Justice said.

In Manning's case, the Federal Bureau of Investigation and U.S. Department of Justice said in three letters this month to state officials that FBI examiners erred in their testimony about hair and ballistics evidence.

One expert overstated conclusions about a hair found in Miller's car by suggesting that it came from an African American, federal authorities said last week.

Manning is black and the two victims, Mississippi State University students Tiffany Miller, 22, and Jon Steckler, 19, were white. The hair sample was the only physical evidence linking Manning to the crime scene.

"We have determined that the microscopic hair comparison analysis testimony or laboratory report presented in this case included statements that exceeded the limits of science and was, therefore, invalid," federal authorities said.

BULLET UNCERTAINTY

In an additional letter this week, they said a firearms examiner testified that bullets retrieved from the victims' bodies and a tree outside Manning's house came from the same gun, when in fact such a conclusion could not be made with absolute certainty.

Mississippi Attorney General Jim Hood accused Manning of waiting until the last minute to raise "this frivolous issue."

According to prosecutors, Manning crossed paths with Miller and Steckler when the couple unwittingly interrupted him burglarizing a car outside a fraternity house they were leaving in December 1992. Manning had a history of theft and other charges and had recently been paroled, prosecutors said.

Manning forced the couple into Miller's car, robbed them and shot them, prosecutors said. Their bodies were discovered on a rural road near the university campus in Starkville.

Manning was arrested after he tried to sell some items belonging to the victims.

In the Texas case, Parr, who was convicted of murdering Joel Dominguez, was pronounced dead at 6:32 p.m. CST (2332 GMT), the state criminal justice department said in a statement.

"These eyes will close, but they will be opened again, my understanding of God is, Jesus has got me through. To my family I love ya'll," Parr said, according to a last statement released by the department.

Parr was the 11th person executed in the United States in 2013 and the fifth in Texas, according to the Death Penalty Information Center.

He had bought marijuana from Dominguez at a Waco convenience store and returned to the store with a friend to get his money back, according to a case summary from the Texas attorney general's office. Parr and his friend, who were armed, forced Dominguez and another man to a fenced area near the store.

Parr pistol-whipped Dominguez, got his money back from him, then told his friend to "smoke 'em," the account said. Parr fatally shot Dominguez in the head, and Parr's friend shot the other man in the hand.

Parr had previous convictions for delivery of cocaine and evading arrest, and prosecutors presented evidence that he was involved in another murder in 2001.

Rich Chinese look abroad to preserve wealth

(AP) ? China's richest people are stepping up investment in U.S. real estate and other foreign assets as they try to preserve their fortunes in the face of a fast-changing economy, a report said Tuesday.

The report by China Merchants Bank and the consulting firm Bain & Co. in China reflects uncertainties about abrupt shifts in an economy in which growth slowed last year to 7.8 percent from the past decade's double-digit rates.

Beijing is trying to shift the basis of growth to domestic consumption and services, reducing reliance on exports and construction that made fortunes for earlier entrepreneurs. Communist leaders have pledged to use taxes and social spending to narrow the huge and politically sensitive gulf between China's small elite and its poor majority.

Investor attitudes are being influenced by "the political environment and possible changes in tax policy," said Chen Kunde, director of China Merchants' wealth management business. They are "switching their focus from deriving more profits to protecting their existing wealth."

Growth in the number of Chinese people with at least 10 million yuan ($1.6 million) in investable assets slowed in 2010-12, according to China Merchants and Bain. The total rose 18 percent over the previous two-year period to 700,000, down from 29 percent growth in 2008-10.

At least 100,000 of those people have more than 50 million yuan ($8 million) while 40,000 have more than 100 million yuan ($16 million), said the report, the third in a series following editions in 2009 and 2011. It was based on questionnaires filled out by 3,300 people and more detailed interviews with about 100 of them and with bank employees.

Sources of wealth for China's financial elite have shifted repeatedly over the past two decades as industries from real estate and manufacturing to the Internet and soft drinks developed.

More recently, entrepreneurs have been squeezed by government policy shifts such as Beijing's effort to rein in surging housing prices. Curbs on real estate purchases and financing have battered revenue for developers.

Almost 60 percent of people surveyed with investments abroad plan to increase them, the report said. Real estate makes up the bulk of investment and top destinations include the United States, Canada, Hong Kong and Singapore.

Half of those who haven't invested abroad plan to start, the report said.

Beijing is encouraging companies and households to invest overseas to diversify the economy. Money flows out of the country are tightly regulated but limits for individual investors have been steadily raised.

China Merchants and Bain caused a stir in 2009 when they reported 60 percent of wealthy Chinese had completed or were considering "investment immigration" ? temporary or permanent residency given by some countries to attract investors.

They said they found similar levels of interest in such immigration this year and added that more than 10 percent of people surveyed expect their children to also pursue it.

This week, Australia's government announced a Chinese toy manufacturer and his family have become the first people to receive visas under a program for "significant investors." It requires an investment of at least 5 million Australian dollars ($5.1 million) in the country.

(AP) ? Any day now, billions of cicadas with bulging red eyes will crawl out of the earth after 17 years underground and overrun the East Coast. The insects will arrive in such numbers that people from North Carolina to Connecticut will be outnumbered roughly 600-to-1. Maybe more.

Scientists even have a horror-movie name for the infestation: Brood II. But as ominous as that sounds, the insects are harmless. They won't hurt you or other animals. At worst, they might damage a few saplings or young shrubs. Mostly they will blanket certain pockets of the region, though lots of people won't ever see them.

"It's not like these hordes of cicadas suck blood or zombify people," says May Berenbaum, a University of Illinois entomologist.

They're looking for just one thing: sex. And they've been waiting quite a long time.

Since 1996, this group of 1-inch bugs, in wingless nymph form, has been a few feet underground, sucking on tree roots and biding their time. They will emerge only when the ground temperature reaches precisely 64 degrees. After a few weeks up in the trees, they will die and their offspring will go underground, not to return until 2030.

"It's just an amazing accomplishment," Berenbaum says. "How can anyone not be impressed?"

And they will make a big racket, too. The noise all the male cicadas make when they sing for sex can drown out your own thoughts, and maybe even rival a rock concert. In 2004, Gene Kritsky, an entomologist at the College of Mount St. Joseph in Cincinnati, measured cicadas at 94 decibels, saying it was so loud "you don't hear planes flying overhead."

There are ordinary cicadas that come out every year around the world, but these are different. They're called magicicadas ? as in magic ? and are red-eyed. And these magicicadas are seen only in the eastern half of the United States, nowhere else in the world.

There are 15 U.S. broods that emerge every 13 or 17 years, so that nearly every year, some place is overrun. Last year it was a small area, mostly around the Blue Ridge Mountains of Virginia, West Virginia and Tennessee. Next year, two places get hit: Iowa into Illinois and Missouri; and Louisiana and Mississippi. And it's possible to live in these locations and actually never see them.

This year's invasion, Brood II, is one of the bigger ones. Several experts say that they really don't have a handle on how many cicadas are lurking underground but that 30 billion seems like a good estimate. At the Smithsonian Institution, researcher Gary Hevel thinks it may be more like 1 trillion.

Even if it's merely 30 billion, if they were lined up head to tail, they'd reach the moon and back.

"There will be some places where it's wall-to-wall cicadas," says University of Maryland entomologist Mike Raupp.

Strength in numbers is the key to cicada survival: There are so many of them that the birds can't possibly eat them all, and those that are left over are free to multiply, Raupp says.

But why only every 13 or 17 years? Some scientists think they come out in these odd cycles so that predators can't match the timing and be waiting for them in huge numbers. Another theory is that the unusual cycles ensure that different broods don't compete with each other much.

And there's the mystery of just how these bugs know it's been 17 years and time to come out, not 15 or 16 years.

"These guys have evolved several mathematically clever tricks," Raupp says. "These guys are geniuses with little tiny brains."

Past cicada invasions have seen as many as 1.5 million bugs per acre. Of course, most places along the East Coast won't be so swamped, and some places, especially in cities, may see zero, says Chris Simon of the University of Connecticut. For example, Staten Island gets this brood of cicadas, but the rest of New York City and Long Island don't, she says. The cicadas also live beneath the metro areas of Philadelphia, Baltimore and Washington.

Scientists and ordinary people with a bug fetish travel to see them. Thomas Jefferson once wrote about an invasion of this very brood at Monticello, his home in Virginia.

While they stay underground, the bugs aren't asleep. As some of the world's longest-lived insects, they go through different growth stages and molt four times before ever getting to the surface. They feed on a tree fluid called xylem. Then they go aboveground, where they molt, leaving behind a crusty brown shell, and grow a half-inch bigger.

The timing of when they first come out depends purely on ground temperature. That means early May for southern areas and late May or even June for northern areas.

The males come out first ? think of it as getting to the singles bar early, Raupp says. They come out first as nymphs, which are essentially wingless and silent juveniles, climb on to tree branches and molt one last time, becoming adult winged cicadas. They perch on tree branches and sing, individually or in a chorus. Then when a female comes close, the males change their song, they do a dance and mate, he explained.

The males keep mating ("That's what puts the 'cad' in 'cicada,'" Raupp jokes) and eventually the female lays 600 or so eggs on the tip of a branch. The offspring then dive-bomb out of the trees, bounce off the ground and eventually burrow into the earth, he says.

"It's a treacherous, precarious life," Raupp says. "But somehow they make it work."

Nonfarm payrolls rose 165,000 last month, the Labor Department said on Friday. March's payrolls were raised to 138,000, 50,000 more jobs than previously reported, and February's job count was revised up to 332,000, the largest since May 2010.

Economists polled by Reuters had expected April payrolls to rise 145,000 and the unemployment rate to hold steady at 7.6 percent. The drop in the unemployment rate last month reflected an increase in employment, rather than people leaving the workforce.

"After a slow build up in terms of a disappointing ADP survey and some of the survey evidence seen over the past week, non-farm payrolls managed a significant upside surprise, not just in terms of the April figure but also upward revisions to previous months.

"Overall, a strong set of numbers which will reassure markets on that the U.S. economy is not as weak as it may have seemed given some of the earlier data, although it may not be strong enough on its own to see renewed talk of tapering QE."

DARRELL CRONK, REGIONAL CHIEF INVESTMENT OFFICER FOR WELLS FARGO PRIVATE BANK IN NEW YORK:

"That was a strikingly good report, every piece of that. Obviously the number for April was only slightly above consensus but the revisions for March and February were quite frankly stunning, those were really nice revisions. To me the bones of the data are looking really good right now.

"This is the type of data that people then begin to look through some of the noise that is in the ISM data, or the PMI data, some of that type of stuff. When the labor markets are firming up, they feel better about that."

"The April numbers were clearly better than expectations, and the fairly large dip we saw in march was largely erased.

"The employment number was definitely the trigger for today's rally, so we'll see if right now if U.S. crude can hold the opening of $1 to $1.25 higher.

When we get up to about $95, it gets a little shaky. If you're a speculator you may look to sell $2 or $3 higher; if you're a buyer you're probably looking at getting in now.

ALAN RUSKIN, HEAD OF G10 FX STRATEGY AT DEUTSCHE BANK IN NEW YORK:

"The payrolls data will definitely go down as substantially stronger than expected, albeit with one weak element: soft hours worked. That will be trumped by substantially stronger payrolls, especially after major prior revisions to February and March data and a decline in the unemployment rate with a decent household employment gain.

"Private payrolls now no longer seem to have had a spring swoon, especially when cold weather is considered (weather was likely a factor behind the -6,000 April construction number. Weather should be a positive factor in the May data."

"As bad as the March number was originally perceived to be, this one's just that much better. It was quite a turnaround. It really does confirm the idea that weather had an impact during the month of March, even though the numbers for March were revised higher.

"And maybe even more importantly, the idea that the employment is holding as well as it is in the face of the fiscal headwinds the economy is currently enduring, is a very positive sign of the economy's underlying fundamental improvements.

"I don't think today's data is strong enough to completely offset some of the weakness we have seen in some other areas, such as overall manufacturing activity and the general pace of economic growth, so I think the Fed will remain fully engaged."

"This report is clearly bullish for commodities. I think that's why crude just popped around 60 cents. The S&P's up and crude's just following that."

"This was a very strong report, it's not necessarily from the headline number, but the upward revisions were quite strong, particularly the February data being revised upwards over 300,000 new jobs.

"Clearly that's lending strength here to the outlook for the U.S. economy and for energy demand, which is quite sensitive to employment outlook and state of employment in general."

OMER ESINER, CHIEF MARKET ANALYST, COMMONWEALTH FOREIGN EXCHANGE, WASHINGTON:

"It was a good number. Certainly better than expected in the headline reading but perhaps more importantly were the very strong upward revisions to the March and February numbers.

"Combined with the decline in the jobless rate the revisions help suggest that the Spring slowdown may not be as pronounced as feared. It is good news for the dollar especially in light of the Fed's statement this week which put even more focus on upcoming U.S. economic numbers."

"It was surprisingly positive. This shows the job market and the economy in general appear to be more resilient than investors had feared. The weight this jobs report carries from month to month can go some way to reviving the notion that the Fed could taper later this year. And the big revision to February suggests we could even see a revision to first quarter growth."

TOM PORCELLI, CHIEF U.S. ECONOMIST, RBC CAPITAL MARKETS, NEW YORK:

"Looking at the headlines alone it is a positive report, however, taking it all in aggregate it is much more mixed.

"A couple of things drive this home, namely average weekly earnings are down and aggregate hours. Those are more forward looking metrics and how it will unfold in the fourth quarter that is not encouraging."

MARKET REACTION: STOCKS: U.S. stock index futures shot up on Friday after data showed U.S. employment rose more than expected in April, pushing the unemployment rate down to 7.5 percent, which could help ease concerns of a sharp slowdown in the economy. S&P 500 futures SPc1 rose 8.5 points and were above fair value, a formula that evaluates pricing by taking into account interest rates, dividends and time to expiration of the contract. Dow Jones industrial average futures DJc1 added 79 points and Nasdaq 100 futures NDc1 rose 17 points.

BONDS: U.S. bond prices fell along with German Bund futures. The benchmark 10-year Treasury note, down 1/32 before the report, was down 19/32 afterwards. Its yield rose to 1.70 percent from 1.63 percent late on Thursday.

FOREX: The dollar rose as high as 99.18 yen, compared with 97.95 yen before the data. It was last at 99.14 yen, up 1.3 percent on the day. The euro was 0.1 percent lower on the day at $1.3059, compared with $1.3118 before the release of the data.

PFT: Kraft says he'd accept gay player on Patriots

In a recent blurb regarding the reported increase in HGH use among NFL players, we suggested that the league isn?t using available legal avenues to compel the NFLPA to honor its 2011 agreement to permit HGH testing perhaps because the league doesn?t really want HGH testing.

Our comment sparked a back-channel discussion with the powers-that-be at 345 Park Avenue, which culminated in a Friday telephone interview with NFL Senior V.P. of Labor Law and Policy Adolpho Birch.

?There is no vehicle we could use that is anything beyond pointless,? Birch said regarding the use of litigation or arbitration to compel the players to honor the existing deal.

Birch explained that the Collective Bargaining Agreement doesn?t specifically mandate testing; it requires negotiation as to the procedures that will be used.? At most, then, a grievance filed under the labor deal would result in a ruling directing the NFLPA to negotiate in good faith ? something the NFLPA surely believes it?s doing.

Litigation in court isn?t an option, Birch said, given the specific terms of the labor deal.

He suggested that the NFL could file an unfair labor practices charge with the National Labor Relations Board, but Birch pointed out that the process could take longer than it would to negotiate an HGH testing agreement without government involvement.? Moreover, compelling the players to submit to testing isn?t the way the league wants to proceed.

?The root of it is that, even if we can force the issue, that is not going to work,? Birch said.? ?The cornerstone of this policy from 1989 forward has been that the players have understood, appreciated, and bought in to what we?re trying to do.? At the end of the day, it?s going to have to be negotiated.?

The problem is that, in the 21 months since the labor deal was signed, little if any negotiation has occurred regarding HGH testing.? From the league?s perspective, it?s unclear precisely what the NFLPA wants in return for a commitment to submit to HGH testing.

?A year ago I would say one thing, three months ago I would say another thing, right now I?ll tell you I have no idea,? Birch said.

So we asked the NFLPA what the players want at the present time.

?They will never say it publicly, but they have admitted in their correspondence
with us that the recent ruling by the Court of Arbitration for Sport poses
legitimate problems,? NFLPA spokesman George Atallah told PFT via email, referring to an arbitration ruling that supposedly raises questions regarding the legitimacy and reliability of HGH testing.? ?We have maintained from the start that a test will be agreed to when there is transparency and reliability of the test and a fair due process to match.? We are working to achieve that.?

Some think the NFLPA wants even more, using HGH testing as leverage to secure, for example, outside arbitration on all player discipline issues, and other concessions.? Regardless, HGH testing won?t happen until the players decide to embrace HGH testing.? The NFLPA ultimately needs to secure buy-in from the players.? In turn, the NFL ultimately needs to give the NFLPA enough bells and whistles to allow that to happen.

In theory, the impasse could continue until the current labor deal expires, in 2021.? As a practical matter, the players could get more serious about embracing HGH testing if Congress ever does anything more than huff and puff about holding hearings and questioning players about HGH testing, HGH use, and the ways in which players get it.

If that happens, everyone could end up with mud on their shoes.? Once players and trainers and doctors and others are placed under oath before Congress, the NFL and the NFLPA lose all control over the final outcome.
