Ardera Pass likely to complete hat-trick in Roeland De Greef - Bettor

Ardera Pass likely to complete hat-trick in Roeland De Greef Goldigger Stakes

After winning two A3 races in a row during the last week of the last month, the P. Cowdrill trained black dog, Ardera Pass, took a few days to build up on that momentum. Now, the young and energetic hound is going to unleash another winning performance in the Roeland De Greef Goldigger Stakes that will be held at Monmore racecourse on Thursday night, September 6.

Running over 480 meters, the two-year-old novice hound will face five worthy rivals. He will break from the orange box. Victory will earn him ?161.

The dashing dog elegantly won Owners Bonus Series - Heat1 on August 23 and finished first in the Dog Of The Month- Ardera Pass/owners Bonus Series Final that was held on August 30.

Prior to this, the talented son of Royal Impact out of Greenfield Lin bagged the title of the A4 480m Flat on August 6. In the month of July, the maverick sprinter accomplished a fabulous hat-trick of victories.

?Ardera Pass has been winning with regular intervals since the beginning of his career. This is going to be his first A1 race. Hopefully, he will demonstrate convincing performance to complete his second hat-trick.

However, he will have to be wary of Mays Arkle who has constantly been on the podium throughout his career. The C. Price trained black dog broke his maiden by winning a T3 race with the mammoth margin of 10 lengths.

The son of Last Bid out of Perrys Lace made himself felt when he elegantly finished first in the Warren Pike Memorial Trophy on August 11. After finishing as the runner-up in the Linda Grogan 60th Birthday Stakes, he nicely sealed the ace title of A3 480m Flat that was his last start.

Thus, Mays Arkle can give tough time to Ardera Pass. A tough tug of war is imminent between these two mighty hounds. A large number of spectators will move to the venue to enjoy the heated action. Let us be a part of this party. Good luck to all the six hounds who are going to present us an amusing contest.

Fallout From the NFL Lockout Litigation For the Entertainment Industry

Henry H. Perritt, Jr., Illinois Institute of Technology, Chicago-Kent College of Law, has published Competitive Entertainment: Implications of the NFL Lockout Litigation for Sports, Theatre, Music, and Video Entertainment, as a Chicago-Kent College of Law Research Paper. Here is the abstract.

The 2011 NFL lockout reveals profound changes in the labor and product markets for the entire entertainment industry, driven by a revolution in technology. This article explores the revolution in the professional sports, theatre, and movie-making industries and concludes that it is fragmenting production, blurring the boundaries between labor markets and product markets, and introducing new forms of competition. As a result, the labor exemptions to the antitrust laws, which featured prominently in the NFL controversy are becoming less relevant, shifting the law's policing of competition to antitrust rule-of-reason analysis, where counterpoises such as labor unions are inactive, and making overaggressive interpretation and enforcement of copyright law a major danger to realization of the new markets' potential.

Genes associated with primary angle closure glaucoma, a leading cause of blindness in Chinese people

ScienceDaily (Sep. 3, 2012) ? Singapore scientists have identified three new genes associated with primary angle closure glaucoma (PACG), a leading cause of blindness in Chinese people. PACG affects 15 million people worldwide, 80% of whom live in Asia.

The discovery, published Aug. 26 in the journal Nature Genetics, was conducted collaboratively by scientists from the Singapore Eye Research Institute (SERI)/Singapore National Eye Centre (SNEC), Genome Institute of Singapore (GIS), National University of Singapore (NUS), National University Hospital's Department of Ophthalmology and Tan Tock Seng Hospital.

The team of scientists led an international consortium that carried out a genome-wide association study (GWAS) of 1,854 PACG cases and 9,608 controls of over five sample collections in Asia. They performed validation experiments in another 1,917 PACG cases and 8,943 controls collected from a further six sample collections from around the world. A total of 1,293 Singaporeans with PACG and 8,025 Singaporean controls were enrolled in this study. This work is the first to study PACG genetics using a genome-wide perspective.

This finding confirms the long-standing suspicion of Professor Aung Tin, the lead Principal Investigator of this project, who is Senior Consultant and Head of Glaucoma Service at SNEC, Deputy Executive Director at SERI, and Professor of Ophthalmology at NUS. Prof Aung has worked on PACG for over 10 years and believes from clinical observations that the disease is strongly hereditary.

"This provides further evidence that genetic factors play a role in development of PACG," said Prof Aung. "It is a major achievement for our Singapore team leading the largest international consortium of doctors and scientists involved in glaucoma research. The results may lead to new insights into disease understanding and open the possibility of novel treatments in the future as well as the potential of early identification of people at risk of the disease."

The study showcases one of many exciting scientific collaborations between GIS and SERI, and highlights the importance and significant advantages of inter-disciplinary collaborations between the two institutes under such joint efforts. The study was funded primarily by the Translational Clinical Research (TCR) program grant from the National Research Foundation that was awarded to SERI in 2008, as well as other grants from the National Medical Research Council (NMRC), Biomedical Research Council (BMRC), and funding from GIS.

GIS Acting Executive Director Prof Ng Huck Hui congratulated the team on the success of the project. "This is an exemplary demonstration of the potential power in genomics being used to dissect complex human diseases with hereditable predispositions. The collaboration between SERI and GIS is synergistic in many broad aspects, and it marries core strengths from both institutions."

Prof Wong Tien Yin, Executive Director at SERI and Provost's Chair Professor and Head, Department of Ophthalmology, NUHS, said, "This is a landmark finding, and may potentially change how we view PACG as a disease with genetic links. It highlights how a collective effort from scientists and clinicians and clinician-scientists can unravel diseases of major importance to Singapore. Because this disease is more common in Asians than in the Western populations, such studies will not be done in the US/Europe. This study has to be done in Asia as it is a disease with more implication for Asians. As such, Singapore has led the way forward."

Dr Khor Chiea Chuen, Principal Investigator, Human Genetics, at GIS added, "Modern genomics is a very powerful tool in dissecting the hereditable basis of common human diseases. It gives all of us a ray of hope, however far-fetched it may be, that one day we will be able to tailor treatments based on individual genetic profile."

"The information on genes involved in PACG has also opened up new and exciting research areas for us that we hope will culminate in new treatment modalities for angle closure glaucoma in the future," Said Dr Eranga Vithana, Associate Director, Basic and Experimental Sciences at SERI, and lead author of the paper.

Prof Janey Wiggs, Paul Austin Chandler Assoc. Professor of Ophthalmology, Harvard Medical School added, "This is a landmark study identifying three genes that contribute to angle-closure glaucoma, a form of glaucoma that is particularly common in Asians. These data are the first critical steps toward a better understanding of the underlying molecular events responsible for this blinding disease."

SERI is the national body for ophthalmic and vision research in Singapore based at SNEC and NUS. The GIS is a research institute under the umbrella of the Agency for Science, Technology and Research (A*STAR), Singapore.

Home Improvement Ideas To Give Your House A Face Lift ...

If your home was built in the seventies or earlier, chances are good that it was built with only a very thin layer of insulation throughout the entire structure. Ideally, the layer should be approximately 27 centimeters or 10.5 inches thick. By increasing the thickness of insulation to the recommended four to six inches, you could easily save a couple of hundred dollars per year.

If you no longer use your garage for parking your cars, you may want to consider remodeling it to be a part of your home. It can serve as an extra bedroom, office or den/family room for your home. Since it is usually attached to your home, the duct work is probably already in place for heating and cooling.

A great way to reduce your chance of mold growth in your household is by making sure your bathroom is well ventilated. Bathrooms that don?t have a window or some sort of vent usually get steamy, but are unable to be rid of the humidity. Eventually this humidity contributes to extensive mold growth.

When it comes to home improvement, be sure that you are not causing your home to awkwardly stand out from the rest of the neighborhood. This will ensure you will be able to resell it and also, that you will not receive scorn from your neighbors. Be creative, but try to lean toward conservative with colors. With additions, keep your the total size of your home somewhat near that of your neighbors.

The kitchen is usually the room that sells the place. Take a look around and see if there are any inexpensive things you can do to your kitchen to make it look recently update. Get rid of that wallpaper or add hardware to your cabinets. Do whatever is simple and quick, but effective. You will be able to mention the update in you listing and buyers like seeing that.

Here is a home improvement tip! Update your decor and save money at the same time by changing your window treatments to energy-efficient varieties. Thermal drapes are made from heavy fabrics that act as insulation to minimize drafts, and blackout curtains block sunlight, keeping your home cooler in the summer months. Many window treatments perform double-duty, combining blackout effects with thermal fabrics.

To reduce the amount of water you use in the shower, install a low-flow shower head. Many varieties provide great pressure while using fewer gallons per minute than standard shower heads. Not only does this save you money on your water bill, but using less hot water means that your water heater doesn?t heat as much, either.

Many companies now seal their new tools to keep them looking sleek for months on a display shelf. As a result, tools like hammers can be very slippery the first time you use them. To make a new hammer less slippery, sand the head before using it. Give any new tool better traction by rubbing the work surfaces with sandpaper or steel wool.

If you can?t afford to take on a major home improvement project inside your home ? spruce up the outside. By tidying up the outside of your house, you give it an instant makeover. A simple case of cleaning up the front yard and filling window boxes and planters with seasonal flowers will brighten up you home considerably. A quick lick of paint on the front door and a new lighting fixture for the porch is the final touch!

In just a few steps, you have discovered how to make the rooms of your home look new and inviting. A few color changes here, new accessories there, and each room is transformed and ready for prime time. Revamp your rooms, over time, using these tips and you will be proud of your home for many years to come.

Yemen air strike kills 10 'Qaeda' members

An air strike in central Yemen on Sunday killed 10 suspected Al-Qaeda extremists and three women companions, but a militant leader escaped unharmed, a tribal chief said.

The raid that targeted two vehicles in the Radaa area "killed five of the guards of Abdulraouf al-Dahab and three women," said the tribal chief, adding that a rocket missed the car of Dahab, who is a local Al-Qaeda leader.

He later said that the toll of dead militants had increased to 10, adding that the vehicle that was hit was a pick-up.

The source said that the plane, which could have been an unmanned drone, fired two rockets. The first missed Dahab's car but the second hit the vehicle behind it, which transported the guards and women.

The attack took place around 4:00 pm (1300 GMT) on the road between the village of Hama and Dahab's village of Manasseh, he said.

Other local and security sources confirmed the attack and the toll.

The United States is the only country that has drones in the region and in recent months has been carrying out strikes on Al-Qaeda targets in the south and east of the country and in the Arabian peninsula.

Dahab is the brother of Tarek al-Dahab, who led Al-Qaeda fighters in a January raid in which they overran the town of Radaa, 130 kilometres (80 miles) southeast of Sanaa.

The militants abandoned the city later the same month, bowing to tribal pressure.

Tarek Dahab was killed in February.

Al-Qaeda in the Arabian Peninsula has taken advantage of the weakness of the central government during a year of protests against ousted president Ali Abdullah Saleh to expand their presence in the impoverished country.

Al-Qaeda loyalists have carried out a spate of deadly attacks against Yemeni security forces and their militia allies since Saleh's successor President Abdrabuh Mansur Hadi came to power, pledging to crush the militants.

In an all-out offensive launched in May, the army retook a string of towns in Abyan province in the south.

Cookbooks 101 ? Blog Archive ? Crock Pot

What is the best size crock pot for a family of 4?

I am in the market for a slow cooker/crock pot, but I want to make sure I buy one that will be good for making standard recipes. If the pot is not 1/2 full of food, will it burn out or dry up?

I have a 6 quart and I have a family of three. The thing is if you want to cook a roast or chicken etc...you want a bigger one. I also have a smaller 4 quart but I only use that one occasionally and I use my 6 quart often.

Your food will burn or dry up if cooked too long...just follow the recipes.

However, there are still Windows users who love the Aero Glass look of the desktop and were not happy that it would not be making an appearance in Windows 8. Now, a software modder claims he has found a way to put Aero Glass back into the RTM version of Windows 8.

In a post on PCBeta.com's message boards, the modder, who goes by the handle "kwanmacher", claims that he has put in the Aero Glass look in the Windows 8 desktop by adding in the source codes. He has also added a screenshot in his post to prove he got the mod to work.

This person claims that he will make the files for the Windows 8 Aero Glass mod freely available to download sometime next week. Hopefully they will work as advertised. We also hope Microsoft allows this kind of mod to be released for Windows 8.

Thanks to FaiKee for the tip!

Ancient Denisovan genome: Relationships between Denisovans and present-day humans revealed

ScienceDaily (Aug. 28, 2012) ? Max Planck researchers have described the Denisovan genome, illuminating the relationships between Denisovans and present-day humans.

The analyses of an international team of researchers led by Svante P??bo of the Max Planck Institute for Evolutionary Anthropology in Leipzig, Germany, show that the genetic variation of Denisovans was extremely low, suggesting that although they were present in large parts of Asia, their population was never large for long periods of time. In addition, a comprehensive list documents the genetic changes that set apart modern humans from their archaic relatives. Some of these changes concern genes that are associated with brain function or nervous system development.

In 2010 Svante P??bo and his colleagues sequenced DNA that they isolated from a finger bone fragment discovered in the Denisova Cave in southern Siberia. They found that it belonged to a young girl of a previously unknown group of archaic humans that they called "Denisovans." Thanks to a novel technique which splits the DNA double helix so that each of its two strands can be used for sequencing, the team was able to sequence every position in the Denisovan genome about 30 times over. The thus generated genome sequence shows a quality similar to genomes that have been determined from present-day humans.

In a new study, which is published in this week's issue of the journal Science, Svante P??bo and his colleagues compare the Denisovan genome with those of the Neandertals and eleven modern humans from around the world. Their findings confirm a previous study according to which modern populations from the islands of southeastern Asia share genes with the Denisovans. In addition, the genomes of people from East Asia, and South America include slightly more genes from Neandertals than those of people in Europe: "The excess archaic material in East Asia is more closely related to Neandertals than to Denisovans, so we estimate that the proportion of Neandertal ancestry in Europe is lower than in eastern Asia," the Leipzig researchers report.

"This is an extinct genome sequence of unprecedented accuracy," says Matthias Meyer, the lead author of the study. "For most of the genome we can even determine the differences between the two sets of chromosomes that the Deniosovan girl inherited from her mother and father." From this the researchers can tell that genetic variation of the Denisovans was lower than in present-day humans. This is likely due to that an initially small Denisovan population that grew quickly while spreading over a wide geographic range. "If future research of the Neandertal genome shows that their population size changed over time in similar ways, it may well be that a single population expanding out of Africa gave rise to both the Denisovans and the Neandertals," says Svante P??bo, who led the study.

The researchers furthermore generated a list of about 100,000 recent changes in the human genome that occurred after the split from the Denisovans. Some of these changes affect genes that are associated with brain function and nervous system development. Others possibly affect the skin, the eye and dental morphology. "This research will help determining how it was that modern human populations came to expand dramatically in size as well as cultural complexity while archaic humans eventually dwindled in numbers and became physically extinct," says Svante P??bo.

Earlier this year, the Leipzig researchers had already made the entire Denisovan genome sequence available to the broader public by publishing it online.

Oops! 101-year-old woman isn't actually Facebook's oldest user

Courtesy of Lee Stern

102-year-old Lee Stern is one of Facebook's oldest users.

By Rosa Golijan

It's understandable that Facebook's chief operating officer Sheryl Sandberg thought that 101-year-old Florence Detlor is the social network's oldest registered user. After all, Lee Stern, another Facebook user, had mistakenly set her date of birth to that of her late brother, Aug. 18, 1913.

Facebook

Facebook COO Sheryl Sandberg posted a photo of Florence Detlor's visit to Facebook's headquarters on Monday. At that time it was suggested that Detlor is the social network's oldest user.

In reality, Stern was born on?Aug. 24, 1910 ??making her 102 years old.

After TODAY.com posted about?Detlor's visit to Facebook's headquarter's in Menlo Park, Calif., Stern's grandson?Mike Latour wrote in to point out that there must be some sort of mistake. "My grandmother, also a Facebook user, is 102," his initial email explained. He provided TODAY.com with a copy of Stern's passport to confirm her date of birth. She additionally accepted a reporter's friend request so that her past Facebook activity could be verified. (She appears to have been using the social network for at least three years.)

Since Facebook's own Sandberg had labeled Detlor as the "oldest registered Facebook user" in a post on Monday, it was fair to assume that the folks at the social network were certain about this detail. But when we notified Facebook about Stern's age, a spokesperson for the social network clarified, telling us that "Florence Detlor is one of the oldest users on Facebook." One of the oldest users.

(And again, the original birthdate on?Stern's Facebook account ? which has since been corrected ?showed her to be younger than her 102 years.)

Both Detlor and Stern use?Facebook to keep in touch with their friends and family. Detlor has made the switch to the dreaded Timeline while Stern is still sticking to the old profile design as long as possible. The 101-year-old seems to be more prone to posting updates of her own while her slightly older counterpart appears to favor commenting on photos posted by dear ones.

When asked how she feels about being the very oldest Facebook user ??assuming that no one else is quietly hiding his or her age ??Stern laughs.

"Well, I wish I was the youngest," she says.

Alexis Antiques Wedgwood Blog: CHARLES DARWIN, A ...

My dear friend Lord Anthony Pulford of Glencoe is a Wedgwood collector and a lover of history.? One of his favorite activities is exploring historic connections regarding all things Wedgwood.? If you have read my posts, you have seen some of his other interesting contributions to this blog.? Many of us Wedgwoodians have been interested in the Wedgwood/Darwin family story over the years, and certainly since the Darwin birthday a couple of years ago.? Sir Anthony has come up with another very interesting tale involving Charles Darwin, another geologist and Ben Nevis, the famous spot in northern Scotland near which Sir Anthony lives.? We don't often see such direct comments TO Mr. Darwin in opposition to his views, but I think you will enjoy this one.? Thank you once again Tony for contributing information of interest to our readers. "The community garden on the grounds of the Kilmallie Hall at Corpach near Fort William [the town nearest to Sir Anthony] contains a stone circle made up of rocks from all over Scotland.? The circle was "opened" by Mr David Sedgwick, a surgeon at the Belford Hospital in Fort William and is dedicated to the memory of Mr Sedgwick's ancestor the Rev. Adam Sedgwick.

??? It is Adam Sedgwick who is the link to Charles Darwin.? Born in 1785, the son of a Dent, Yorkshire, vicar, he was educated at Sedburgh School and Trinity College Cambridge, eventually becoming Woodwardian Professor of Geology in 1818, a position he held until his death in 1873.

?? A leading geologist of his day, one of his geology students was a young Charles Darwin who, in 1831, accompanied him on a trip into Wales.? They corresponded while Darwin was on the Beagle Expedition and afterwards.? Sedgwick never accepted the case for evolution made in Darwin's book On the Origin of the Species in 1859.? After reading the book he wrote to Darwin saying;

? 'If I did not think you a good tempered & truth loving man I should not tell you that.... I have read your book with more pain than pleasure.? Parts of it I admire greatly;? parts I laughed at until my sides were almost sore; other parts I read with absolute sorrow; because I think them utterly false & grievously mischievous - You have deserted - after a start in that tram-road of all solid physical truth - the true method of induction - & started up a machinery as wild, I think, as Bishop Wilkins' locomotive that was to sail with us to the Moon'.? Despite this difference of opinion, the two remained friends until Sedgwick's death.

?? The Sedgwick Museum in Cambridge, opened in 1903, contains a number of Darwin artifacts including rocks collected on the Beagle voyage as well as notebooks, scientific instruments and his pistol."?

Ohio hospital shooting: Mercy killing or murder?

CLEVELAND (AP) ? John Wise watched a tear roll down his wife's face as he stood alongside her bed in the intensive care unit. She'd been unable to speak after suffering a stroke and seemed to be blinking to acknowledge him, Wise confided to a friend who had driven him to the hospital.

The couple had been married 45 years and Wise told his friend that they had agreed long ago they didn't want to live out their years bedridden and disabled.

So a week after Barbara Wise's stroke, investigators say, her husband fired a single round into her head. She died the next day, leading prosecutors to charge the 66-year-old man with aggravated murder Wednesday in what police suspect was a mercy killing.

The shooting leaves authorities in a dilemma some experts say will happen with greater frequency in coming years as the baby boom generation ages ? what is the appropriate punishment when a relative kills a loved one to end their suffering?

More often than not, a husband who kills an ailing wife never goes to trial and lands a plea deal with a sentence that carries no more than a few years in prison, research has shown. In some instances, there are no charges.

"It's a tragedy all around that the law really isn't designed to address," said Mike Benza, who teaches law at Case Western Reserve University in Cleveland.

A New York man in March was sentenced to six months in jail after suffocating his 98-year-old disabled mother and slitting his own wrists. He told authorities he had just been told he had cancer and believed he was going to die soon, and feared no one would care for his mom. A Washington state man accused of shooting his terminally ill wife this year told investigators she had begged him to kill her; he is free on bail while prosecutors weigh charges.

Almost always, there are deeper issues involved with the accused, including depression, their own health problems and the stress of taking care of a dying spouse, said Donna Cohen, head of the Violence and Injury Prevention Program at the University of South Florida.

Seeing a dying or disabled spouse suffering can be enough to push someone over the edge, said Cohen, who is writing a book called "Caregivers Who Kill."

"Men will hit a wall when they can't do anything else," she said. "That's usually a trigger."

She worries this will happen more often with longer life expectancies and a continuing shortage of mental health services for older people.

In the early 2000s, testifying a Florida legislative committee, Cohen cited research showing that two in five homicide-suicides in the state involved people 55 and older. The number of cases grew among older people while staying the same with those under 55.

Police say Wise took a taxi from his home in Massillon, calmly walked into his 65-year-old wife's room on Aug. 4 at Akron General Medical Center without drawing any attention, and shot her.

Juries are often sympathetic to those who kill a spouse out of what is portrayed to be love and compassion, but the message that sends is unclear, said Wesley J. Smith, a California lawyer who wrote a 2006 book "Forced Exit: Euthanasia, Assisted Suicide and the New Duty to Die."

"Where's the stopping point?" he said. "There almost comes to become a cultural acceptance that certain people are better off dead than alive."

Those who kill a loved one to end the suffering are acting out of their interests, he said. "We're really putting Grandpa out of our misery," Smith said.

Wise's lawyer has said that he was a good man who was devoted to his wife.

"I am absolutely confident that everything that he's ever done for his wife has been done out of deep love, including the events that just recently transpired," said attorney Paul Adamson.

The former welder also suffered from nerve damage that made his hands and feet numb, survived bladder cancer and had diabetes, said Terry Henderson, a 30-year steel plant co-worker.

Those issues could help his case if it goes to trial. "The facts surrounding her death are sympathetic and may actually foster a plea before trial," said Jeff Laybourne, a prominent Akron defense attorney.

But just because his wife may have been suffering isn't a valid defense under the law, Laybourne said.

Other factors that could determine whether the case goes to trial include the timing of the shooting and that it happened in such a public place.

Henderson thinks Wise may have snapped under the weight of both of their health concerns. "He never dreamed, given his history of medical problems, that this would happen to her before he'd go," Henderson said.

That kind of situation can be deeply depressing for a person dependent on the care of a spouse who suddenly is disabled, said Dr. Peter DeGolia, a physician specializing in care for the aging at University Hospitals Case Medical Center in Cleveland.

"If this man was dependent on his wife for care and basic well-being, and suddenly she's gone, he's going to feel very vulnerable, highly at risk," he said. "Older white males are the highest risk group for carrying out suicide plans."

It's a scenario that DeGolia said can be defused with help from social workers and hospice care for the dying.

"There are lots of options," he said, "aside from going and shooting them."

Romney Aide: Ryan Will Focus on Iowa

CHARLOTTE, N.C. -- Mitt Romney's campaign plans to make extensive use of new running mate Paul Ryan in Iowa, a state where Romney's opposition to a federal wind energy tax credit has given Democrats hope they can prevail there.

"We have a number of states that are competitive where we believe he helps us," Romney senior advisor Kevin Madden told reporters on Sunday. "Obviously, his home state of Wisconsin and some of these other Great Lake states. But Iowa in particular, that is a state where I think his life story is important for others, something that I think helps him connect with a lot of those voters there."

Romney's opposition to the wind tax credit has created concern among Iowa Republicans. The credit costs the federal government $1.6 billion annually and is due to expire at the end of this year. About 7,000 people work in the wind-energy sector in Iowa, making it the nation's second-largest wind producing state. The state could lose up to 3,000 jobs if the tax credit is not renewed, according to the American Wind Energy Association.

Most recent Hawkeye State polls show Romney and President Obama in a dead heat.

"It's going to be close there, I believe, all the way until Election Day," Madden said. "But we think with the more they get to see of Congressman Ryan, the more they get to hear about the Romney/Ryan message on fixing the economy, that we're going to continue to do well there."

Madden also said that Ryan and Romney would campaign "on different tracks" until the GOP convention. He said Ryan would not make an initial visit to Florida, but denied it had anything to do with the House Budget Committee chairman's controversial plans for reshaping Medicare, which the Obama campaign thinks will turn off seniors in Florida and elsewhere.

"This has more to do with expanding our bandwidth," he said. "Governor Romney is going to be talking about the issues that are important to Floridians. And I think Congressman Ryan?s going to be able to be down in Florida during this campaign and will be doing the same, at some point."

Trial hinges on dying man's gesture ID'ing gunman

CINCINNATI (AP) ? Paralyzed and hooked up to a ventilator, David Chandler was two weeks from death when police arrived at his hospital room to question him about the person who shot him. They wanted to know if he could identify a suspect, and they had a photo to show him.

Chandler was unable to communicate except with his eyes as he lay in bed attached to myriad tubes and with a brace around his neck. His eyes opened barely more than a slit at times; he was instructed to blink three times for yes and twice for no. One detective quizzed him, and another videotaped his responses.

Chandler didn't respond with blinks to every question in the 17-minute video, and there were solo blinks. But triple blinks came in response to repeated questions asking if he knew the shooter and whether the person in the photo was the culprit.

An upcoming murder trial hinges on the videotape of those blinks, a rare effort by a prosecution to show a defendant has been identified by gesture: the nod of a head, squeeze of a hand, blink of an eye.

Legal experts say such cases ? while not unheard of ? are unusual, and dying identifications relying on gestures rather than words are often not used in trials because of concern over reliability or differing interpretations. But some have been used in murder cases around the country that have ended in convictions.

Challenges facing jurors in such cases include determining whether victims are fully aware of what is being asked and are in control of their movements.

"People blink naturally anyway, so the question could be whether the blinking is really identifying someone or is automatic or the result of something going on medically," said Michael Benza, a visiting professor of law at Case Western Reserve University in Cleveland.

Chandler, 35, was shot in the head and neck as he sat in a car early Oct. 28, 2010, in Cincinnati. He remained paralyzed from his injuries when police interviewed him Nov. 2. He eventually went into a coma, dying 10 days later.

The man authorities say he identified, 34-year-old Ricardo Woods, is charged with murder, felonious assault and weapons counts and faces up to life in prison if convicted. A hearing in the case is set for Monday, which had been the original trial date. The judge could set a new trial date at the hearing.

Prosecutors would not comment on motive, although authorities have suggested the Cincinnati men knew each through drug deals. Woods has previous convictions in Hamilton County for aggravated robbery, felonious assault and trafficking in cocaine.

The defense suggests that Chandler's condition and drugs used to treat him could have affected his ability to understand and respond. Woods' attorney, who tried unsuccessfully to block the video evidence, insists the blinks are inconsistent and unreliable.

"There are times when detectives asked questions and he didn't blink at all, and other times there are too many blinks," said attorney Kory Jackson.

Prosecutors insist Chandler clearly identified Woods as the gunman.

"While the case is unusual, we believe ? and the judge agreed ? that the victim's interview and identification of the defendant as his assailant is reliable," prosecutor's spokeswoman Julie Wilson said.

Judge Beth Myers of Hamilton County Common Pleas Court ruled that jurors could see the videotape, saying she found the blinks reliable. She said they were made by pronounced, exaggerated eye movements and not by involuntary blinking.

During the hospital interview, Chandler also was asked whether he knew the shooter's name. The detective drew a pen across an alphabet list, asking Chandler to blink three times to indicate the first letter of the name or nickname.

The detective stated that Chandler blinked three times when the pen stopped on "O," although the alphabet was turned away from the camera. Authorities allege Woods was at times known as "O," but Jackson says there is no record of that.

Jackson also contends that police erred and "were too suggestive" when they asked Chandler to identify one photo without other choices.

Jonathan Rapping, a law professor at Atlanta's John Marshall Law School, believes the use of only one photo rather than the typical array of photos may prove problematic. Using one photo violates a defendant's constitutional right to a fair trial if it is unnecessarily suggestive and increases the likelihood of misidentification, he said.

"Clearly showing one photo is suggestive that 'this is the person,'" Rapping said.

But he said that when a victim and a suspect know each other, it can be argued there is less chance for a mistaken identification.

Prosecutors said they could use one photo because they contend Chandler knew the suspect and the identification came quickly after the crime.

"The bottom line is that the judge allowed it into evidence," Wilson said.

Victims' dying declarations based on nonverbal identifications have been used in other murder cases.

In Oklahoma City, a man was convicted in 1985 of first-degree murder and arson in the burning death of his wife, who could not speak due to her injuries and survived only two days. But she was able to nod to identify her husband as the person who poured gasoline on her and set her on fire.

In Boynton Beach, Fla., two men were convicted of first-degree murder and attempted robbery in the 2007 shooting of a man who was left paralyzed and unable to speak before he died. But he was able to identify both defendants by blinking his eyes when shown photo lineups.

Assistant State Attorney Andrew Slater in Florida's Palm Beach County said he was careful to show the court that the family also had communicated with the victim through blinks and detail the steps police took to establish them as legitimate responses.

"I think I was able to show he knew what he was doing, and that is what gave the identification procedure reliability," Slater said, adding that videotape of such blinks "should be even better" for establishing reliability.

Blinks that look decisive and defined would help prosecutors, while the defense would benefit if they appear random or involuntary, said Harvard Law School professor Ronald S. Sullivan.

Sullivan said dying declarations in general can be powerful testimony, "because the imagery is that of someone speaking from the grave."

Both Sides Are Happy with Ryan as Veep

After what felt like years of relentless speculation, we finally know that Mitt picked Paul Ryan to be his vice president. Amazingly, both the Republicans and the Democrats seem to be happy with his choice.?

RELATED: Single People Have a Crush on Obama

The Republicans are more than happy with the decisions to choose Ryan. He's young, but he has experience, and he's tapped into the base of the party more than Romney is. As Talking Points Memo's?Evan McMorris-Santoro?writes, conservatives "have been waiting for the moderate Romney shoe to drop," and Ryan's finally done it. Ryan gives them a hardcore conservative with strong economic values who's in touch with the base of the party. As?Daily Intel's Jonathan Chait points out,?as Ryan goes, so goes the Republican party:?

If he doesn?t want something to happen, it won?t happen (say, several bipartisan deals to reduce the deficit that he squashed.) If he wants something to happen, however foolhardy (like putting the entire House GOP caucus on record for his radical budget plan despite a certain veto) it will happen. It is Ryan?s party.

Meanwhile, the Democrats are practically overcome with joy over the Ryan pick. They've campaigned against him in the past, so he's a familiar target, and his budget plan calls for "the end of Medicare as we know it." Where could they go wrong. An Obama campaign official told Buzzfeed's Michael Hastings that Ryan is "pretty smart," but still called the choice insane. "[Ryan] should be way out of his league at this water depth," he said. Two Democrats who spoke to The Hill's Niall Stanage and Amie Parnes were considerably more excited.?"I haven't been this happy waking up since I was 12 and got a BMX for Christmas," said one. "I think we're all licking our chops this morning," said another. "The president has spent the last several months attacking the Republican budget and who better to be the VP pick than Ryan? Fits into our narrative in the best possible way."

The Obama campaign was quick to release an ad attacking the Ryan/Romney ticket, focusing mainly on their problems with Ryan's budget plan:?

10 Things to Be Grateful For Each Day

Tech tipsComputer Tricks

Gratitude will lead your mind out along the ways by which things come.

Wallace D. Wattles

There is so much that I am thankful for. As I lie in bed each morning and at bed time, my mind instantly starts to run through all that I can say ?thanks? about.

I know that I could spend all day listing the many things that spark my gratitude, but instead I focus on 10 things each day.

When I open my eyes and see the sun peeping through the cracks in the window, I give thanks for a new day. As I wiggle my toes and stretch my fingers, I am grateful for having them to help me do good things for others. At bed time I reflect on my day.

Practice having an attitude of gratitude.

Random acts of kindness begins with me.? As I wait on the traffic light to turn green, I am thankful for the opportunity to say a kind word or give a kind gesture to another road user.

Although I can easily find 10 different things to be grateful for each day, I always include thanks for loved ones and the opportunity to live right with others. I recognize that people around me who show me love help to make life worth living. I also recognize that having the opportunity to show love to others is something I am meant to do.

Something to consider doing. Commit to remaining eternally grateful. I commit to being truly thankful for all the blessings that come my way, even if I fail to see it right away. I know there is much to be thankful for!

3 Self-Reflection Questions:

  1. Do I ever neglect to say thanks for my abundance and prosperity?
  2. Am I grateful for the people in my life?
  3. Do I encourage those around me to express thanks to their Creator every day?

Are You Investing Your Best Resources in the Wrong People ...

It is easy to see other people making this mistake. It is more difficult to catch yourself doing it. I?ve been guilty plenty of times.

For example, a few years ago, while I was still CEO of Thomas Nelson, I met with an important author. In the course of the meeting, I learned he was unhappy with the cover design we had done for his previous book.

Being the people-pleaser I am, I thought I could fix his problem. ?I will take personal responsibility for this next cover,? I announced. ?I will work with you directly to make sure we get a cover you love.?

I then hired a designer I knew who had delivered stellar results for another one of our authors. In a few weeks, the designer delivered six superb cover comps. I made a few suggestions, the designer revised his work, then I submitted them to the author.

He didn?t like any of them.

I spent an hour on the phone with him, as he berated the designer. Undaunted, I rolled up my sleeves and spent the afternoon personally searching through a stock photo library, trying to find just the right image?not exactly the best use of my time as a CEO.

But finally I found a photo I loved. This is it, I thought. Perfect!

I went back to the designer and had him create several more comps based on the new photo. I submitted the new batch to the author, confident he would love one of the options. I followed up with a phone call.

He hated them all.

Again, he criticized the designer. He then came after me. ?If you would just spend the money and hire a decent designer, we could get onto more important things.? He lectured me like this was the first time I had ever done this.

Silly me. I hired another designer and went through one more round with him. We produced twenty-one cover comps in all. He didn?t like any of them.

Finally, we acquiesced and used a cover designed by his team. I wish I could show it to you, especially compared to the others.

With that, I woke up to the fact that I had invested all this time, money, and emotional energy and had not moved the needle one bit. It was a total waste. He was incorrigible.

The resources I wasted on him would have been better spent elsewhere.

We finished out our contract with him but passed on offering him another one. We had had enough. We let him go to another publisher.

Leaders often make this same mistake in various areas of their lives. For example,

  • A mother invests all of her emotional energy in a difficult child to the neglect of the quiet, compliant one. The difficult child gets worse and the compliant one begins acting up to get attention.
  • A corporate executive spends most of her time helping under-performing salespeople rather than provide leadership and inspiration to her top producers. She then wonders why she can?t keep her best people.
  • A pastor expends so much of his time trying to fix broken people that he doesn?t have the energy to develop the leaders who could help shoulder the burden. He constantly grumbles about his workload.

What can you do if you are in this situation?

Make sure you are investing your best resources?including your time and energy?in your best people. Here?s how:

  1. Acknowledge that your resources are limited. Your time, money, and energy are finite resources. It?s easy to forget this and overcommit. But it?s a zero-sum game. Every time you say ?yes? to one person, you are saying ?no? to others.
  2. Become aware of where your resources are going. It?s easy to think the situation is temporary or an exception. But is it? This is the little lie that keeps us stuck if we aren?t careful. Look back over your calendar and make an honest assessment. It will reveal the truth.
  3. End unproductive or unhealthy relationships. This is the hard part. If you can?t end them, then at least establish boundaries. If you need inspiration or moral support, read Henry Cloud?s excellent book, Necessary Endings: The Employees, Businesses, and Relationships That All of Us Have to Give Up in Order to Move Forward.
  4. Identify the people you should be investing in. This is the most important step. Change your focus. Who are the individuals you have overlooked? Who are the people who should be getting the bulk (or at least more) of your resources? Who are the ones who represent the future?
  5. Schedule time on your calendar to serve these people. Good intentions are important, but they are not enough. Like the old adage says, ?What gets scheduled gets done." The opposite is also true, ?What doesn?t get scheduled doesn?t get done.?

Yes, Jesus spent time with broken people. He healed the sick. He comforted the broken-hearted. He ministered to the outcasts.

But he spent the bulk of his resources on just twelve people. He proactively invested in them, knowing that his mission was, humanly speaking, dependent on their success.
