The New Perimeter Initiative: Will Security Trump Trade? ? The ...

The Canada-United States Law Institute at Case Western Reserve University School of Law and The University of Western Ontario Faculty of Law presents the 2012 Henry T. King, Jr. Annual Conference in Cleveland, Ohio at the CWRU School of Law on March 22 and 23. Conference attendees ?will analyze the ongoing border negotiations of the Beyond the Border Working Group and Regulatory Cooperation Council and their implications for business, security, and trade.? ?Ambassador Gary Doer, U.S. Ambassador to Canada David Jacobson, U.S. Ambassador to Canada David Jacobson, and Rear Admiral Michael N. Parks are scheduled as keynote speakers. Topical sessions will discuss threat detection by law enforcement, harmonization of employment regulations, trade and jobs, and cybersecurity.

The Canada-United States law Institute had been publishing proceedings of its annual conferences since 1978, available in print and via HeinOnline. The conference traditionally features a mix of academics, business people, and government officials.

Joint law enforcement operations build on past, evolving, and continuing cooperative efforts between Canada and the United States. Personnel enforce their own country?s laws, not the other country?s laws. An emphasis on criminal enforcement, rather than anti-terrorism may be helpful.

The first lesson learned from the post-9/11 era (Strategic Prosperity Framework) is the need to align goals, based on a joint threat assessment and an acknowledgement of varying priorities (security vs. commerce) and constitutional frameworks. The second lesson is the need for a specific action plan. The third lesson is to put the right people in charge, with enough authority to avoid the need for continuous internal negotiations. Consistent oversight by government bodies, continued goodwill among the officials, and political staying power are also required.

Successes include the Shiprider program, 96-hour notice for merchant vessels, a joint crew manifest oversight program, and joint training programs. The Coast Guard and Transport Canada are working together to address regulatory gaps, overlays, and redundancy. Three Maritime Operations Centers share information jointly, while respecting constitutional and privacy concerns. Past examples of cooperation include NORAD, Search and Rescue, and environmental and emergency response programs. Areas for improvement include information law, possible harmonization of two distinct identity cards, multi-modal screening, and programs that give commerce more predictability without sacrificing security.
